NO PURCHASE NECESSARY
OPEN TO RESIDENTS OF AZ, CA, ID, NV, OR, UT, TX, WA 18 YEARS AND OLDER ONLY
1. TO ENTER: Beginning at 12:00 a.m. on 5/18/15 through 11:59 p.m. on 6/14/15 there are two (2) ways to enter the “Winco Soccer Sweepstakes” (the “Sweepstakes”):
1.) Online: log on to http://wincofoods.com/soccer and follow the on-screen entry instructions.
2.) Instagram: Using the Instagram app, entrants will “re-gram” the “You could Win Soccer Gear” image from the WinCo Instagram page (@wincofoods) and include #wincosoccer and #sweepsentry and a mention to @wincofoods in the post to enter. All qualifying entries must follow @WincoFoods on Instagram and must have a public profile.
Limit one (1) entry per email address/person/household regardless of the entry method. Use of any robotic, automatic, programmed or similar entry method or more than one entry per day will void all entries and result in disqualification. Sponsor reserves the right to remove any entry that does not adhere to the requirements of these Official Rules, as determined in Sponsor's sole discretion, and/or disqualify the entrant. Released Parties (as defined below) are not responsible for late, incomplete, invalid, unintelligible, illegible entries, and such entries will be disqualified. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes at any time.
2. ELIGIBILITY: Open to residents of the AZ, CA, ID, NV, OR, UT, TX, WA, 18 years of age or older at the time of entry except for employees of Mondelēz Global, LLC (“Sponsor”), WinCo Foods (“Retailer”), HMT Associates, Inc., Soccer United Marketing, LLC (“SUM”), United States Soccer Federation, Inc. (“U.S. Soccer”), their affiliates, subsidiaries and agencies (collectively “Released Parties”), and members of their immediate family or persons living in the same household. Void where prohibited.
3. RANDOM DRAWING: Winners will be selected in a random drawing conducted by Retailer. Odds of winning will depend on the number of eligible entries received among all entry methods. The return of any prize notification as undeliverable may result in disqualification and the prize may be awarded to an alternate winner.
4. PRIZES/APPROXIMATE RETAIL VALUES (ARVs): Twenty (20) Prizes: One (1) U.S. Soccer Ball, One (1) U.S. Soccer Jersey and One (1) U.S. Soccer Duffel Bag, ARV: $175. Total prize value: $3,500. No substitutions or transfers of prizes permitted by winners. Sponsor reserves the right to substitute a prize of equal or greater value. Limit one (1) prize per email address/person/household.
5. GENERAL RULES: All income taxes resulting from acceptance of prizes, if any, are the responsibility of the winners. All winners will be notified by email/mail/phone after the date of the applicable drawing and may be required to complete, sign, and return an Affidavit, Liability and Publicity Release within seven (7) days of attempted delivery, or prize will be forfeited. If prize notification is returned as undeliverable, or the affidavit is not returned within the required time period, or in the event winner does not comply with any other requirements, the prizes will be forfeited in their entirety. By entering the Sweepstakes, entrants accept and agree to these Official Rules and the decisions of Released Parties, which shall be final in all matters. By accepting prizes, winners agree to hold Released Parties, Instagram their respective parents, subsidiaries, affiliates, directors, officers, employees and assigns, promotion agencies and agents harmless against any and all claims and liability arising out of participation in this Sweepstakes and/or use or redemption of prize. Acceptance also constitutes permission to the Released Parties to use winner(s) name(s), likeness (es) (and biographical information) for marketing purposes without further compensation or right of approval, unless prohibited by law. Released Parties are not responsible for lost or late mail, or for technical, hardware or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any human error which may occur in the processing of the entries in this Sweepstakes. If, in the Release Parties opinion, there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties compromise the integrity of the promotion, the Released Parties reserves the right to modify or terminate the Sweepstakes in a manner deemed reasonable by the Released Parties, at the Released Parties sole discretion. If terminated, prize will be awarded in a random drawing using all non-suspect entries as of the date of termination. In the event a dispute arises as to the identity of a potentially winning online entrant, entries made by internet will be declared made by the name on the online entry form. All federal and state laws apply.
6. WAIVER: By entering this Sweepstakes, participants (and their parents/legal guardians) waive all rights to claim punitive, incidental and consequential damages, attorneys' fees or any damages other than actual out-of-pocket costs incurred to enter. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of any participant or Released Parties in connection with the Sweepstakes shall be governed by and construed in accordance with the internal laws of the State of New Jersey without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws.
7. LIABILITY RELEASE AND INDEMNITY: By entering the Sweepstakes, participant agrees that the Released Parties, and each of their respective parents, subsidiaries, affiliated companies, employees, officers, directors, shareholders, agents, retailers, distributors and representatives are indemnified, released and will be held harmless by participant from any and all liability, for any damages, injuries or losses of any kind to person(s), including death, or property, arising directly or indirectly from the acceptance, possession, misuse or use of the Prize
Participants agree to indemnify and hold harmless the Released Parties from any and all liability arising out of or relating in any way to participant’s participation in the Sweepstakes and to release all rights to bring any claim, action or proceeding against the Released Parties arising out of participation in the Sweepstakes, use of the Sweepstakes website(s), or receipt or use of the Prize or any other prize, including but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property (including to any computer systems resulting from participation in or accessing or downloading information in connection with the Sweepstakes), which may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Sweepstakes or receipt or use of any prize. Entrants assume all liability for an injury or damage caused, or claim to be caused, by participation in the Sweepstakes, the use of the Sweepstakes website(s), or the acceptance, receipt, or use of any prize or prize component. Participants further agree that in any cause of action, the Sweepstakes Entities’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Released Parties be liable for attorney’s fees.
The Released Parties assume no responsibility for and will disqualify entries that are: stolen, late, lost, illegible, incomplete, invalid, unintelligible, altered, tampered with, unauthorized, fraudulent, damaged, destroyed, delayed, misdirected, not delivered, not received, or that have incorrect or inaccurate entry information, whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes, or by any human, mechanical or electronic error that may occur in the processing of the entries in the Sweepstakes, or other errors appearing within the Official Rules or in the Sweepstakes related advertisements. The Released Parties assume no responsibility for any typographical or other error in the printing of the offer, administration of the Sweepstakes, errors in processing entries, identifying the Winners, in the announcement of the Prize and Winners, the delivery of any Prize, any problems or technical malfunction of any telephone network or lines, computer systems, online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or on any web site including, or any combination thereof, including, without limitation, any injury or damage to Entrant’s or any other person’s computer system/software related to or resulting from participation in, uploading any materials or downloading any materials in the Sweepstakes. Use of any device to automate or subvert entry is prohibited and any entries received by such means will be void.
